Peter Tisdall talks about Personal Injury

I started work in Beenleigh in 1979 when I was employed by Walter Ehrich. Chris Monahan was already working for Walter.  At that time our office was located in Main Street next to Rudy Giebel’s haberdashery shop.

I started doing personal injury work at the outset and have continued to do so since that time.  During the last 35 years I have had the privilege of acting for hundreds of local clients.

However, the practice of personal injury claims has changed dramatically over that period. Despite the often declared intentions of politicians to provide a simpler, more streamlined and cheaper system of processing claims, the reverse has occurred.  The claims regime is now so complex that it is virtually impossible for an individual claimant to prosecute their claim without expert legal assistance.  In terms of costs, the injured claimant is now paying more because the costs which should be borne by negligent drivers, negligent occupiers and negligent employers has been transferred, in many cases, to the claimant.

Another unfortunate development in the intervening years has been the “commoditisation” of these claims and the associated development of a legal business model of large “factory” type personal injury firms, promoted by slick and costly advertising campaigns, trawling claimants with “customer service centres” and “pop up” stalls located in Shopping Centres.  Sixty second computer based appraisal of claims, and customer service centres manned by paralegals, do not allow the necessary analysis and assessment of the claimant’s prospects of making a viable claim, in these complex areas.  As a result, if your case is not the most straight forward one you may not receive the attention it deserves and requires.

As always, the best outcomes for the client are not able to be legislated for by politicians, but can only be achieved by the diligent efforts of a competent and experienced practitioner giving the client direct and consistent personal attention.   That is what I have provided and continue to provide to my clients to ensure they obtain the appropriate compensation for their injury, or loss.
